Defendant Third, being the registered proprietor under s.340 National Land Code 1965, proved on the balance of probabilities that Plaintiff's entry into a lease and the lodging of a caveat unlawfully interfered with Defendant Third's exclusive proprietary rights; Defendant Third established entitlement to compensatory and exemplary damages and valuation evidence justified awarding RM3,985,106.19 and costs RM30,000.00 to Defendant Third.
