The Plaintiffs' present claims are barred by res judicata because the earlier final judgment had determined as a foundational fact that the Defendant's shares were credited as fully paid and ordered a buy‑out based on a court‑appointed auditor's valuation; permitting the Plaintiffs to reopen those issues via new valuations would be an abuse of process, hence the action is obviously unsustainable and must be struck out.
