The High Court allowed the appeal because the Sessions Court had expressly named the insurer as a party by its order dated 3.11.2023 and therefore it possessed the requisite legal interest and locus standi to apply; the Sessions Court erred in striking out the insurer's applications for lack of locus standi and the matters (Lampiran 7 and Lampiran 8) must be remitted to the Sessions Court for substantive hearing on the merits.
