The application to intervene was dismissed because the Proposed Intervener failed to demonstrate a legal interest in the land required under Order 15 r.6 (evidence showed only commercial/license-like interests), attempted conflation of Order 15 and Order 89 was improper because O.89 requires possession, and delay and conduct undermined the exercise of the court’s discretion; therefore leave to intervene was refused and the application dismissed with costs.
