The High Court held that under Order 15 Rule 6(2)(b)(ii) the joinder of Mohamad Bin Saad was appropriate because his alleged libel claim arose from the same material facts as the existing Claim and Counterclaim, his presence was necessary to effectually and completely determine the disputes, and it was just and convenient to determine the matters together; accordingly the appeal was dismissed and the Sessions Court order to add him as a co-defendant was upheld.
