The appeal was dismissed because the preservation order was properly granted: the RM350,000 was identifiable, the second defendant failed to prove transfer by bank statement, there are serious issues to be tried and the balance of convenience favors preservation; accordingly the interim preservation order stands and costs were awarded to the respondent.
