The Court held that it has the power under Order 34 r.2(3) to strike out claims for non-compliance even without an unless order but, on the facts (both parties had breaches, no chronic misconduct by Plaintiff, and the non-compliance was not so serious as to defeat case management purpose), striking out was disproportionate; adjournment granted and Plaintiff ordered to pay costs RM6,000.
