The Appellant failed to show sufficient cause to set aside the judgment because it knew its solicitor had been discharged, had multiple adjournments and ample time to engage new counsel, its representative who attended lacked authority and the Appellant made no evidential or procedural preparations; the Sessions Court properly heard evidence and entered a final judgment which was affirmed by the High Court, rendering this Court functus officio and the issues now raised barred by res judicata; therefore the appeal is dismissed and costs awarded to the Respondents.
