The High Court allowed the appeal because JPJ failed to commence prosecution within the one‑month period under section 80(5), rendering the seizure defective, and the magistrate misinterpreted section 80(3) by effectively ordering both temporary release and later forfeiture; consequently the magistrate's forfeiture order was set aside and the RM5,000 bail returned.
