Court allowed the appeal: the refusal to permit amendment was challengeable on appeal after trial and amendment was allowed; administrator breached statutory and fiduciary duties by selling estate land without obtaining fresh sanction and without proper valuation, rendering the sale voidable under PAA s.60 and s.17 SEDA and the purchasers' titles were defeasible as immediate purchasers, therefore High Court orders were set aside and plaintiffs' re-amended claim granted.
