The Court held that s.366(4) confers continuing supervisory powers enabling ancillary or consequential orders necessary for implementation, but the sanction order is a statutory contract and the Court does not have general power to set aside the sanction order on the basis the scheme is merely inoperative; allegations of breach or repudiation are to be determined in separate proceedings. Accordingly the 4th Respondent's application to set aside or declare lapsed the sanction order and for leave to proceed with the prior action was dismissed with costs.
