The court held that the Minister's exercise of discretion under s6(2) to waive the 3% deposit and set RM200,000 was lawful, justiciable but not shown to be illegal, irrational or procedurally defective on the affidavits before the court; the incumbent Minister's affidavit was admissible; waiver under s6(2) is distinct from an exemption under s2 and need not be gazetted; therefore the judicial review application was dismissed.
