The Federal Court held that Deepak Jaikishan is fact specific and does not impose an absolute prohibition on filing a single notice of appeal where multiple orders exist; a single notice is valid provided the particulars of each decision are clearly and concisely set out so as to avoid ambiguity, prejudice or miscarriage of justice. Accordingly the Court allowed both appeals and remitted the cases to the Court of Appeal to be heard on the merits.
