The Court held that a Proposed Decision under s.36(1) may be subject to judicial review where it sufficiently affects rights or is a decisive preliminary step; here the Commission failed to give proper notice and to conduct a fair, separate investigation of the 2019 complaint (Radzwan) and conflated it with 2018 complaints, resulting in procedural impropriety and denial of the right to be heard; consequently the High Court was correct to quash the Proposed Decision and the appeal is dismissed.
