On proper construction the deed of assignment merely changed the mode of payment by directing interim payments from the main contractor to the plaintiff and did not release or transfer the 1st defendant's personal liability to pay for goods supplied; accordingly there were no triable issues and summary judgment for the plaintiff was warranted while the defendants' strike out application failed.
