The High Court allowed the appeal, holding the Sessions Court erred in deciding the plaintiff's claim on the basis of illegality which was not pleaded because the illegality was non-ex facie and only emerged through trial evidence; consequently the defendant should have pleaded the facts giving rise to illegality under Order 18 r8 ROC 2012. The High Court remitted the matter to be heard on the merits and, on rehearing, found for the plaintiff on wrongful termination and awarded damages, interest and costs.
