The court held that the statutory preconditions for remand under ss 4(1) and 4(2) POCA 1959 are satisfied by the production of the required written statements; there is no statutory obligation to produce the police diary and failure to do so is not fatal where the written statements and affidavits disclose sufficient facts to enable the Magistrate to exercise judicial discretion; therefore the application for habeas corpus was dismissed.
