Having assessed the case on its merits the Majistret exercised discretion under section 294 KTJ, finding the defendant's advanced age, chronic medical condition and family dependence constituted sufficient extenuating circumstances to warrant release on bond with police supervision rather than immediate imprisonment under s39C(1) ADB; the sentence of a two‑year bond with RM3000 surety and monthly reporting was therefore appropriate and proportionate in the circumstances.
