Because the accused pleaded guilty but was shown to be a repeat offender whose prior fine did not deter him, and given the significant quantities of mitragynine involved, the Magistrate concluded that imprisonment was necessary for deterrence and public interest; the court sentenced the accused to 20 months imprisonment for the first amended charge and 10 months imprisonment for the second amended charge, to run from the date of sentence.
