The court disallowed the postponement request because the 14th Defendant filed the Order 33 application after an inordinate and inexcusable delay (more than six years after close of pleadings and at the last minute after evidence), there were no valid grounds to further delay a trial already protracted for over seven years, and the disposal of the Order 33 application could be completed before or simultaneously with the decision on the main enclosure so no prejudice justified postponement.
