The Court held that the power to suspend the operation of the SMA 2013 under section 1(7) is vested in the State Authority and entails a personal, non‑delegable requirement to form an opinion that suspension would not be contrary to public interest and purchasers' interest; section 4(1) appointment of a Commissioner of Buildings to administer the Act does not confer the power to suspend or to adjourn AGMs, therefore the COB was not empowered to grant the requested postponement and the High Court's declarations to the contrary were incorrect.
