The Court found the totality of evidence established that the sale to the Plaintiff occurred and the transfer was completed; the handwriting expert's evidence was inconclusive and insufficient to prove forgery on the balance of probabilities; Defendants failed to call OCBC as necessary witness to support their assertions; accordingly the Defendants' defence and counterclaim failed and the Plaintiff is entitled to vacant possession.
