The court found the prosecution had established a prima facie case against OKT1 at the close of the prosecution but, after considering defence evidence, concluded the defence raised reasonable doubt and successfully rebutted the statutory presumption of distribution in respect of OKT1 due to conflicting testimony and absence of direct forensic linkage; the prosecution failed to establish a prima facie case against OKT2 and OKT3 at the close of prosecution and they were discharged without being called to enter defence.
