The appeal is dismissed as academic; the 1988 amendment to Article 121(1) did not remove judicial power from the High Courts and Act A704 is not struck down; section 4 POCA is not invalidated on the basic structure/separation of powers ground in the circumstances; Maria Chin and Rovin Joty were not shown to be per incuriam; High Court rightly dismissed the habeas corpus application because the appellant was no longer detained and the challenge to Act A704 and s.4 POCA is unsupported.
