Khee San Berhad was permitted to intervene because it established at least a prima facie claim as a creditor/contingent creditor for RM68,934,995 based on the Respondent's ledger entries and supporting payment evidence; the executed subordination letters related only to specific MIB facilities (RM10,000,000 and RM4,000,000) and did not negate the remainder of KSB's intercompany claim; allegations of common directors and fiduciary breaches did not bar KSB from intervening or preclude the Court from considering KSB's evidence at this interlocutory stage.
