After maximum evaluation the court found material inconsistencies about presence and identity of independent witnesses, a failure by the investigating officer to obtain evidence from available customers/staff, and conduct of the complainant inconsistent with having been alarmed; on that basis prosecution failed to prove a prima facie case under s.506 and the accused was acquitted without being called to enter his defence.
