The impugned Ministry Directive of 5.12.1986 is invalid and a nullity because it was not made pursuant to any statutory power in Act 301, it departs from the Cabinet policy and conflicts with existing statutory instruments (notably P.U.(A)134/1982), and its enforcement under section 9(1) Act 301 was unlawful; consequently enforcement against the applicant interfered with her Article 11 religious freedom and Article 8 equality rights and she is entitled to the declaratory reliefs granted.
