On the balance of probabilities the Plaintiff's version was more inherently probable: the Investigating Officer's independent findings and the First Defendant's admission that he proceeded on yellow/red established breach of duty by the First Defendant; the defences of inevitable accident and contributory negligence failed; Plaintiff entitled to full damages for proven general and special losses and reasonable private medical costs; interest and costs ordered accordingly.
