The court found the statutory requirements of POCA s4(2)(a) were satisfied for the detainees in question as shown by exhibits MAY2 and MAY3 and the Magistrate properly issued detention warrants (exhibit MAY1); accordingly there was no basis to issue writs of habeas corpus. For a named set of detainees the existence of s19A detention orders rendered those applications academic. Requests for broader declaratory relief were inappropriate for habeas corpus and belonged to the Appellate and Special Powers Division.
