The court held that plaintiffs may prove they voted by oral evidence under Evidence Act 1950 s59, the claim before the court is one of misrepresentation by the defendant (not enforcement of an election manifesto or negation of association rights), and because triable issues exist the claim is not plain and obvious and cannot be struck out under Order 18 Rule 19.
