The High Court found the Industrial Court's decision was legally flawed and irrational because it failed to give due weight to the proven dishonest conduct that impaired the employer's trust and confidence; the misconduct was sufficiently serious to render dismissal proportionate, therefore the Industrial Court award of reinstatement/compensation was quashed and certiorari was granted.
