The court held it has no jurisdiction to challenge the prosecution's choice to offer the lesser charge under s.43(1) APJ; applying established sentencing principles and considering mitigation (young first offender, early guilty plea, adverse weather and loss of control, negative drug test, limited means) and public interest, a fine of RM5,000 with 5 months imprisonment in default and endorsement of conviction on driving licence is a lawful, proportionate and consistent sentence.
