The appeal was dismissed because KPI had not made a final decision rejecting the applicant's request; KPI's letter merely deferred consideration pending the bankrupt's personal attendance for investigation under Rule 255 and to enable KPI to decide issues under s.52 and s.54(1). The claim was therefore premature and s.86 was inapplicable at this stage; costs awarded to KPI.
