The court dismissed the prosecution's appeal and upheld the magistrate's sentence of a RM1,000 fine in default 3 months imprisonment because the offence involved a non-functioning imitation rifle with no evidence of use in crime, the accused was to be treated as a first offender for this charge, pleaded guilty at first mention, had limited means and dependants, had spent 11 days remand, COVID-19 prison overcrowding favoured non-custodial measures, and the totality of fines for three contemporaneous charges (total RM3,500) made the imposed fine proportionate and not excessive.
