The court held that s.294 KTJ remains applicable despite the mandatory imprisonment wording in s.411 KK, supported by judicial precedent and parliamentary amendment to s.294; applying s.294 in this case, after weighing public interest against substantial mitigating factors (voluntary plea, personal circumstances, remand period, no prior record, dispute context), justified releasing the accused on a two‑year bond with RM7,000 security and reporting conditions as a lawful suspended sentence.

The charge was materially defective for omitting the essential wording 'dengan sengaja menolong' required by s414 and the prosecution failed to call a material witness (Hasliza Kasim) whose evidence was necessary to complete the narrative; taken together the prosecution did not establish a prima facie case and the accused was discharged without being called to enter his defence.

Given the child's age (13), first offender status, early guilty plea, remorse and supportive social report, the court exercised its discretion under Section 91(1)(b) of the Child Act 2001 to release the child on a good behaviour bond for 2 years with RM1000 surety and ordered the parent/guardian to enter a two-year bond under Section 93(1) without surety subject to reporting conditions; rehabilitation and avoidance of custody for juveniles outweighs imposition of immediate imprisonment in these circumstances.
