The High Court upheld the Session Court's finding that no privity of contract existed between the lawyer and the 2nd and 3rd defendants because they did not sign the Warrant to Act, there was no pleading alleging an express or implied contract, and their presence and payments were properly characterized as assistance to the 1st defendant; accordingly the dismissal was correct.
