Because the representations for reinstatement were made before 1.1.2021, s.35 of Act A1615 preserves the unamended Industrial Relations Act for those proceedings; therefore the challenge to the Industrial Court award should proceed under the unamended regime by way of judicial review and not by appeal to the High Court, making the High Court appeal improperly instituted; the High Court's judgment is set aside and the Industrial Court award is reinstated.
