The Court of Appeal held the Tribunal acted within its jurisdiction and its award of liquidated damages from the SPA stipulated date was not tainted by illegality, irrationality or procedural impropriety; the High Court erred in quashing the Tribunal award on the basis of legitimate expectation and failing to assess substance and evidence; the Tribunal’s factual findings on completion and certification of common facilities and calculation of LAD were sustainable and the Tribunal’s decision was restored.
