Because the Power of Attorney was not validly created until compliance with section 4 of the Power of Attorney Act 1949, and that deposit occurred after the donor's adjudication as bankrupt, the PA was not effective at the time of bankruptcy; therefore the Plaintiff had no rights to the property which vested in the Director General of Insolvency and the Originating Summons must be dismissed.
