The Court held that loss of goodwill RM416,800 was recoverable because the goodwill purchase was within the appellant's knowledge and the loss was within contemplation under s74, but the award of loss of profit RM500,885.97 for 2002-2004 was set aside because those profits related to periods when the distributorship was subsisting and therefore could not have been caused by the termination in July 2004; concurrent findings were interfered with on the ground of legal error as to causation and double compensation.
