The High Court held the Industrial Court's findings were supported by cogent evidence that the employee was on approved leave, responsible superiors and contractors were in place, and there was no cogent proof the employee committed misconduct; further there was a breach of natural justice by not holding a domestic inquiry, therefore the Industrial Court's decision should stand and the judicial review application is dismissed.
