The Sessions Judge correctly found the Appellant failed to prove on the balance of probabilities that the five cheques were payments for alleged contract works; the absence of customary documentary evidence of works meant the evidence supported repayment of the earlier RM600,000 advance, and no error of law or fact was demonstrated on appeal.
