A vehicle suspected to be stolen falls within s.413 CPC and seizure must be reported to a Magistrate (only Magistrate may order custody); s.24(4) Police Act authorises detention as evidence for up to 48 hours (or longer only if proceedings commence) and detention beyond 48 hours without proceedings is unlawful; RTA ss.10 and 12 impose a duty on the Registrar to inspect vehicles prior to registration.
