The High Court held there was no bona fide question of title because the plaintiff had a 1992 sale agreement, vacant possession since 1995 and a prior 2015 Sessions Court judgment affirmed by the High Court declaring ownership; the defendant had impliedly consented to adjudication by participating in pleadings, applications and trial steps; therefore the Sessions Court had jurisdiction and the defendant's strike out application under O18 r19 and Section 69 failed; the appeal was dismissed with costs.
