The SPAs were void ab initio because the Housing Controller had no lawful power to extend or modify the Schedule H terms; parties could not validly contract out of the prescribed Schedule H form; therefore the agreements were illegal and respondents were entitled to restitution under s66 of the Contracts Act 1950; appeals dismissed and High Court orders for refund and costs affirmed.
