Leave to commence arbitration to pursue monetary reliefs against the 3rd applicant was refused because the proposed intervener failed to show exceptional circumstances: the claims are pure monetary and can be dealt with under the scheme via proof of debt and the scheme’s adjudication process; permitting arbitration would prejudice other scheme creditors and undermine the scheme. Limited leave was granted only to the extent necessary to commence arbitration for filing a stay application under s16 CIPAA to avoid a procedural catch-22.
