The breach was held to have occurred on or after the Completion Date (31/10/2018); the Plaintiff's calculation based on 2013–2017 fees was therefore irrelevant; the Plaintiff failed to prove losses from the date of breach because the primary records were not produced, the tabulated ID-44 was inadmissible as secondary evidence and invoices alone did not establish loss of profit; burden remained on Plaintiff to prove losses on a balance of probabilities, hence claim for losses dismissed.
