The Court allowed the appeal and held that the Second Defendant was bound and liable for the debt under the Agreements entered into while she was a partner: lack of personal knowledge or internal segregation of duties does not absolve a partner; retirement in May 2017 did not discharge liability for obligations incurred while a partner absent publication/notice or agreement discharging liability; therefore the Sessions Court erred in dismissing the summary judgment application.
