Rule 7(3A) of the Rules of Court of Appeal 1994 encapsulates the principles in Ladd v Marshall; applying Rule 7(3A) the respondent satisfied the availability/reasonable diligence and determining-influence limbs for the Addendum Order; the Federal Court therefore dismissed the Attorney General's appeals, allowed admission of the Addendum Order as fresh evidence (and parts of the supplemental application), granted leave for the judicial review matter to proceed and remitted the case to the High Court for substantive hearing before a new judge.
