An undischarged bankrupt who has not obtained the prior sanction of the Director General of Insolvency is legally incompetent to commence the originating summonses; the narrow statutory exception for personal injury claims does not apply to the Plaintiff's claims concerning preservation of charged land or alleged defamation/harassment; accordingly the preliminary objections succeed and the originating summonses are struck out.
